{"id":1370,"date":"2016-06-22T13:45:00","date_gmt":"2016-06-22T12:45:00","guid":{"rendered":"https:\/\/newsmediauk.org\/lords-to-debate-ip-bill-next-week\/"},"modified":"2024-05-03T10:11:56","modified_gmt":"2024-05-03T09:11:56","slug":"lords-to-debate-ip-bill-next-week","status":"publish","type":"post","link":"https:\/\/newsmediauk.org\/blog\/2016\/06\/22\/lords-to-debate-ip-bill-next-week\/","title":{"rendered":"Lords to Debate IP Bill Next Week"},"content":{"rendered":"<p>The Investigatory Powers Bill will be debated by peers as it receives its second reading on Monday. &nbsp;<\/p>\n<p>The <a href=\"https:\/\/newsmediauk.org\/write\/MediaUploads\/PDF Docs\/NMA_Investigatory_Powers_Bill_Second_Reading_Briefing_-_PRESS_FREEDOM.pdf\">News Media Association believes further comprehensive and robust safeguards are vital to protect journalistic activities<\/a>, material and sources against undue state surveillance. &nbsp;<\/p>\n<p>The Bill governs the use of covert surveillance powers that could shadow every step of a journalist&rsquo;s news gathering from tracking internet research, to locating sources through communications data, to recording conversations, to allowing access to the media&rsquo;s encrypted database of unpublished material. &nbsp;<\/p>\n<p>The media is united in its call for stronger journalistic protections.&nbsp;Specifically, the Bill must be changed:<\/p>\n<ul>\n<li><span style=\"background-color: transparent;\">to require prior judicial approval, after hearing media representations;<\/span><\/li>\n<li>to require prior notice to be given to the media of the authorisation application and;<\/li>\n<li>to include a robust set of freedom of expression conditions for the applicant to satisfy;<\/li>\n<li>to ensure the media&rsquo;s right to participate in the hearing of an application before an independent judge, with rights of swift appeal, before use of the power is authorised.<\/li>\n<\/ul>\n<p>This ensures that the judge has actually heard all the relevant information necessary to make the decision on approval of any authorisation and its extent.<\/p>\n<p>These requirements should apply to any authorisation of the various investigatory powers set out in the Bill and RIPA in relation to journalistic activities and sources.<\/p>\n<p>The Government has acknowledged in previous debates on the Bill that &ldquo;journalists serve a public interest&rdquo; and that a &ldquo;vital aspect of journalism&rdquo; is &ldquo;the non-disclosure of the source of journalists&rsquo; material.&rdquo;<\/p>\n<p>The NMA has met with ministers and will continue to press for vital journalistic protections as the Bill continues its passage.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Investigatory Powers Bill, which will pose a threat to investigative journalism unless key safeguards are introduced, will go to the House of Lords for its second reading on Monday. &nbsp;<br \/>\nThe NMA believes that further comprehensive and robust safeguards are vital in order to enable&#8230;<\/p>\n","protected":false},"author":4,"featured_media":1371,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[1,26],"tags":[],"class_list":["post-1370","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news","category-pressfreedom","news","pressfreedom"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.4 -
